Following an oral hearing on 1 April 2016, the District Court of Düsseldorf partially granted the plaintiffs’ claim. It ordered the defendant to pay plaintiff 2 €605.19, with interest at five percentage points above the applicable base rate from 3 November 2015, and to indemnify her for €147.56 in pre-litigation legal costs. The remainder of the claim was dismissed. The plaintiffs were ordered to bear 70% of the litigation costs and the defendant 30%. The judgment was declared provisionally enforceable, subject to security provisions.

Die Beklagte wird verurteilt, an die Klägerin zu 2) 605,19 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 3.11.2015 zu zahlen und die Klägerin zu 2) von vorgerichtlichen Rechtsanwaltskosten in Höhe von 147,56 EUR freizustellen. Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Kläger zu 70 % und die Beklagte zu 30 %.
Das Urteil ist vorläufig vollstreckbar. Den Parteien wird nachgelassen, die Vollstreckung der jeweils anderen Partei durch Leistung einer Sicherheit in Höhe von 110 % abzuwenden, wenn nicht die vollstreckende Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
