The creditor challenged the Obergerichtsvollzieher’s cost assessment of 30 December 2016, arguing that charging for the bailiff’s own certification was improper because the creditor had already supplied a multi-page copy certified under § 169(3) ZPO. The Düsseldorf Local Court rejected the reminder. It held that making the bailiff’s own fee-bearing certification before service did not amount to incorrect handling under § 7 GvKostG. The decision was issued without court fees.
§ 7 GvKostG; § 169(3) ZPO; fee-bearing certification by a bailiff of a copy supplied by an unrepresented party. It is not incorrect handling within the meaning of § 7 GvKostG for a bailiff, before service, to prepare a separate certification subject to fees, even where the party has provided a multi-page copy certified in accordance with § 169(3), sentences 1 and 2, ZPO. The party-provided certification does not preclude the bailiff’s own certification for service. The result distinguishes the Federal Court of Justice’s decision of 23 October 2003, I ZB 45/02.

Die Erinnerung der Gläubigerseite vom 11.01.2017 gegen den Kostenansatz des Obergerichtsvollziehers L vom 30.12.2016 zum Aktenzeichen X wird zurückgewiesen.
Die Entscheidung ergeht gerichtsgebührenfrei.
