Following oral proceedings, Düsseldorf Local Court maintained the payment order issued by Wedding Local Court to the extent that it required the defendant to pay the plaintiff EUR 1,024, plus interest at five percentage points above the applicable base rate on EUR 124 from 24 March 2014 and EUR 900 from 3 December 2017. The court set aside the payment order and dismissed the claim for the remainder. It apportioned litigation costs 46% to the plaintiff and 54% to the defendant, assigning transfer costs to the plaintiff.

für Recht erkannt:

Der Vollstreckungsbescheid des Amtsgerichts Wedding vom 02.01.2018, Az. XXX, wird aufrechterhalten, soweit die Beklagte verurteilt worden ist, an die Klägerin 1.024,00 Euro nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz aus 124,00 Euro seit dem 24.03.2014 und aus 900,00 Euro seit dem 03.12.2017 zu zahlen.

Im Übrigen wird der Vollstreckungsbescheid aufgehoben und die Klage abgewiesen.

Die Kosten des Rechtsstreits haben die Klägerin zu 46 % und die Beklagte zu 54 % zu tragen. Hiervon ausgenommen sind die Kosten der Verweisung des Rechtsstreits, die die Klägerin zu tragen hat.

Das Urteil ist vorläufig vollstreckbar. Dem jeweiligen Vollstreckungsschuldner wird nachgelassen, die Vollstreckung gegen Sicherheitsleistung in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages abzuwenden, sofern nicht der jeweilige Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
