für Recht erkannt:

Die Forderung des Klägers in Höhe von 55.208,00 € wird zur Insolvenztabelle im Insolvenzverfahren über das Vermögen der I & Q-GmbH zur laufenden Nr. 3 festgestellt.

Der Beklagte hat die Kosten des Rechtsstreit zu tragen.

Das Urteil ist vorläufig vollstreckbar. Dem Vollstreckungsschuldner wird nachgelassen die Vollstreckung durch Sicherheitsleistung in Höhe von 110% des aus dem Urteil vollstreckbaren Betrags abzuwenden, wenn nicht der Vollstreckungsgläubiger zuvor Sicherheit in Höhe von 110% des jeweils zu vollstreckenden Betrags leistet.
