hat das Amtsgericht Düsseldorf

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 16.03.201

durch den Richter I

für Recht erkannt:

Die Beklagte wird verurteilt an den Kläger € 98,59 nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 30.09.2017 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits haben der Kläger zu 72% und die Beklagte zu 28%zu tragen. Die Kosten der Streithelferin trägt der Kläger zu 72%. Im Übrigen findet eine Kostenerstattung nicht statt.

Das Urteil ist vorläufig vollstreckbar.
