Following the oral hearing on 10 April 2019, Düsseldorf Local Court convicted U of negligent intoxication in road traffic in concurrence with intentional driving without a licence. It imposed six months’ imprisonment and directed the administrative authority not to issue U a new driving licence for one year and eight months after the judgment becomes final. Der Angeklagte U wird wegen fahrlässiger Trunkenheit im Verkehr in Tateinheit mit vorsätzlichem Fahren ohne Fahrerlaubnis zu einer Freiheitsstrafe von 6 Monaten verurteilt.

Die Verwaltungsbehörde wird angewiesen, dem Angeklagten vor Ablauf von 1 Jahr und 8 Monaten seit Rechtskraft dieses Urteils keine neue Fahrerlaubnis zu erteilen.

Die Kosten des Verfahrens sowie seine notwendigen Auslagen trägt der Angeklagte.

Angewendete Vorschriften: §§ 316 I, II, 52, 69a StGB, § 21 Abs. 1 Nr. 1 StVG.
