Résumé Omnilex

In a dispute between S GmbH and F GmbH, the Düsseldorf Local Court referred a question to the Court of Justice of the European Union concerning the distance used to calculate compensation under Article 7(1) of Regulation 261/2004. It asked whether distance should be measured over the entire journey from the initial departure point to the final destination, or only over the segment on which the delay occurred, where passengers reach their destination through a stopover and possibly a change of aircraft. The court stayed the proceedings pending the CJEU’s decision.

Regeste Omnilex

Article 7(1) of Regulation 261/2004; distance relevant to passenger compensation on itineraries involving a stopover and potentially a change of aircraft. The referring court asks whether “flight” denotes only the segment on which the delay occurred or the complete carriage from the first departure point to the final destination, assuming the Regulation applies to the relevant segment. The question was referred to the CJEU for a preliminary ruling; the referring court made no determination on the interpretation.
