The Federal Court rejected the defendant's appeal against the Hamburg Regional Court judgment as unfounded. It clarified that for tax evasion cases involving only the concealment of tax-relevant facts, the threshold for a particularly serious case under § 370(3) sentence 2 no. 1 AO is 100,000 euros; the 50,000-euro threshold applies to cases in which unjustified payments are obtained from the tax office. Although the trial court had mentioned the wrong threshold, this did not affect the judgment because it still did not assume particularly serious cases on the relevant counts and the higher court excluded any possibility of milder sentences. The defendant was ordered to bear the costs of the appeal.

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Hamburg vom 12. November 2010 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Ab einem Hinterziehungsbetrag von 50.000 € sind Steuern in großem Maße verkürzt bzw. im großen Ausmaß nicht gerechtfertigte Steuervorteile erlangt (§ 370 Abs. 3 Satz 2 Nr. 1 AO), wenn der Täter ungerechtfertigte Zahlungen vom Finanzamt erlangt hat, etwa bei Steuererstattungen durch Umsatzsteuerkarusselle, Kettengeschäfte oder durch Einschaltung von sog. Serviceunternehmen. Beschränkt sich das Verhalten des Täters dagegen darauf, die Finanzbehörden pflichtwidrig über steuerlich erhebliche Tatsachen in Unkenntnis zu lassen - wie hier durch Nichterklärung eines Teils der Umsätze -, liegt die Wertgrenze zum großen Ausmaß bei 100.000 € (BGH, Urteil vom 2. Dezember 2008 - 1 StR 416/08 -, Rn. 38, 39, BGHSt 53, 71, 85). Die Strafkammer ist zwar zunächst unzutreffend von der 50.000 €-Grenze ausgegangen. Hierauf beruht das Urteil jedoch nicht. Die Strafkammer hat nämlich gleichwohl bei den entsprechenden Taten keine besonders schweren Fälle i.S.v. § 370 Abs. 3 AO angenommen. Der Senat vermag auszuschließen, dass das Landgericht bei Vermeidung des Irrtums mildere Einzelstrafen und eine noch mildere Gesamtstrafe verhängt hätte.
