Résumé Omnilex

The Federal Court dismissed the defendant's revision against the Landgericht Kiel judgment. It held that, despite imprecise wording on culpability, the reasons of the judgment still sufficiently showed that the trial chamber was convinced that the prerequisites for psychiatric commitment under § 63 StGB, including a secured substantial diminution of responsibility, were met. The court additionally indicated that, in preparing future decisions under §§ 57, 67d, and 67e StGB, the defendant's dangerousness toward his wife requires early therapeutic and social stabilization measures, including secure separation and use or expansion of existing guardianship.

Regeste Omnilex

§ 63 StGB; review of psychiatric commitment on revision; the appellate court may uphold the measure if, notwithstanding imprecise wording in the reasons, the judgment as a whole sufficiently discloses that the trial court was convinced of the statutory prerequisites, including a secure substantial diminution of culpability (consid. 1). In preparing later decisions under §§ 57, 67d, 67e StGB, the competent authorities must take account of the specific source of danger and may need to ensure early therapeutic and social stabilization measures, including secure separation from the endangered person and use or extension of existing guardianship, possibly through appropriate instructions (consid. 2).

Question juridique clé

Whether the defendant's revision against the Landgericht Kiel judgment was well-founded.

Solution extraite

The revision was unfounded and was rejected in summary proceedings.

Motifs extraits

The Federal Court found no reversible error in the judgment and treated the appeal as unfounded under § 349(2) StPO.

Question juridique clé

Whether the findings on diminished responsibility and the prerequisites of § 63 StGB were sufficiently clear despite the lower court's wording.

Solution extraite

Yes. The court could still sufficiently infer from the overall reasons that the trial chamber was convinced that the requirements of § 63 StGB, including a secured substantial diminution of culpability, were met.

Motifs extraits

Although the trial court's wording on culpability was ambiguous, the judgment as a whole made the factual basis for the measure clear enough.
