Tenor

Auf die Revision der Angeklagten wird das Urteil des Landgerichts Köln vom 30. Oktober 2012 mit den Feststellungen aufgehoben, soweit es sie betrifft.

Die Sache wird insoweit zu neuer Verhandlung und Entscheidung, auch über die Kosten des Rechtsmittels, an eine andere Strafkammer des Landgerichts zurückverwiesen.

Gründe

1 Die Verurteilung der Angeklagten wegen Besitzes von Betäubungsmitteln in nicht geringer Menge in drei Fällen, jeweils in Tateinheit mit Beihilfe zum Handeltreiben mit Betäubungsmitteln in nicht geringer Menge, hält sachlich-rechtlicher Prüfung nicht stand.

2 1. Nach den Feststellungen des Landgerichts verbrachte der mitverurteilte (nicht revidierende) Ehemann der Angeklagten "um Weihnachten 2010" (Tat 1) und Anfang September 2011 (Tat 3) jeweils nicht geringe Mengen von Betäubungsmitteln in die gemeinsame Wohnung, von wo er es gewinnbringend weiterverkaufte.

3 Aus diesen Feststellungen ergibt sich nicht, dass die Angeklagte Besitz an den Betäubungsmitteln erlangte. Hierzu wäre nicht allein eine tatsächliche Zugriffsmöglichkeit erforderlich, sondern auch ein Besitzwille; dieser ist nicht festgestellt.

4 Aus der Darlegung, dass die Angeklagte von der Lagerung und dem Verkauf ihres Ehemannes wusste, ergibt sich auch keine Gehilfenstellung. Die Angeklagte hatte keine Garantenstellung zur Abwendung von Straftaten ihres Ehemannes; konkrete Beihilfetaten sind nicht festgestellt.

5 2. Im Fall 2 (Juni 2011) der Urteilsgründe ist festgestellt, dass der Mitangeklagte 600 Gramm Amphetamin und 500 Ecstasy-Tabletten mit Wissen der Angeklagten in die Wohnung brachte, dort streckte und portionierte und gewinnbringend weiterverkaufte. Die Angeklagte "übergab hin und wieder schon verpackte Betäubungsmittel an Abnehmer und nahm das Geld entgegen".

6 Hieraus ergibt sich zwar eine unbekannte Anzahl von konkreten Beihilfetaten, nicht aber Besitz und Beihilfe zum Handeltreiben mit der (nicht geringen) Gesamtmenge, wovon das Landgericht rechtsfehlerhaft ausgegangen ist. Der neue Tatrichter wird gegebenenfalls die (Mindest-) Anzahl der Fälle und die dabei umgesetzte Rauschgiftmenge festzustellen haben. Ein Besitzwille der Angeklagten hinsichtlich der Gesamtmenge ist auch in diesem Fall nicht festgestellt.
