Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Frankenthal (Pfalz) vom 29. November 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend zu den Ausführungen des Generalbundesanwalts in der Antragsschrift vom 28. Juni 2013 bemerkt der Senat:

Auch die Rüge, der Eröffnungsbeschluss sei wegen unrichtiger Besetzung unwirksam, hat keinen Erfolg. Selbst wenn ein Besetzungsfehler bei Erlass des Eröffnungsbeschlusses vorläge, hätte dies dessen Unwirksamkeit nicht zur Folge; seine bloße Fehlerhaftigkeit kann gemäß § 336 Satz 2 StPO i.V. mit § 210 StPO mit der Revision nicht gerügt werden (vgl. BGH, Beschluss vom 18. Februar 1981 - 3 StR 269/80, NStZ 1981, 447 m. Anm. Rieß; Meyer-Goßner, StPO, 56. Aufl., § 207 Rn. 11, 14 jeweils mwN).
