The Federal Court dismissed the defendants’ revisions against the Berlin Regional Court judgment. It held that the defensible treatment of several purchase transactions as one assessment unit does not stand in the way of a conviction for gang-related drug trafficking. The court therefore found no reason to disturb the lower court judgment and ordered each appellant to bear the costs of the appeal.
§ 30a Abs. 1 BtMG, § 52 StGB; repeated purchase acts and a single assessment unit in gang drug trafficking: the fact that several acquisition acts are legitimately combined into one assessment unit does not exclude the assumption of gang-related trafficking. The qualification of the conduct under § 30a(1) BtMG is not defeated merely because the factual procurement process is assessed as a unit in competition law terms (consid. implicit).

Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Berlin vom 26. April 2013 werden nach § 349 Abs. 2 StPO als unbegründet verworfen.
Jeder Beschwerdeführer hat die Kosten seines Rechtsmittels zu tragen.
Ergänzend bemerkt der Senat:
Die vertretbare Zusammenfassung der mehrfach durchgeführten Einkaufshandlungen zu einer einzigen Bewertungseinheit steht der Annahme bandenmäßigen Handeltreibens nicht entgegen (vgl. BGH, Urteil vom 17. Juni 2004 – 3 StR 344/03, BGHSt 49, 177).
