The BGH rejected the defendants' revisions against the LG Essen judgment. It held that the review under § 349 Abs. 2 StPO revealed no error to their detriment. In addition, the Court addressed the adhesion claim concerning defendant O. A.: although personal service of the compensation request could not be proven, the defect was cured because defence counsel with comprehensive service authority had actual knowledge of the request. The Court therefore upheld the adhesion decision by order without oral hearing and ordered the defendants to bear the costs and necessary expenses arising from the appeal.

Ein fehlender Zustellungsnachweis führt nicht zur Unwirksamkeit der Zustellung, wenn das Schriftstück einer Person zugeleitet wurde, an die die Zustellung gesetzlich gerichtet werden konnte, und diese den Inhalt tatsächlich und zweifelsfrei zur Kenntnis genommen hat (vgl. § 189 ZPO). Im Revisionsverfahren kann über die Adhäsionsentscheidung ohne Hauptverhandlung entschieden werden, wenn die Voraussetzungen des § 349 Abs. 2 StPO hinsichtlich Schuld- und Straffrage vorliegen und nur noch über die Entschädigung zu befinden ist (§ 406 Abs. 5 Satz 2, § 406a Abs. 2 Satz 2 StPO).

Adhäsionsverfahren: Heilung der unterlassenen rechtzeitigen Zustellung des Entschädigungsantrags an den Angeklagten

Tenor

  1. Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Essen vom 19. August 2013 werden als unbegründet verworfen, da die Nachprüfung des Urteils aufgrund der Revisionsrechtfertigungen keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

  2. Die Beschwerdeführer haben die Kosten ihrer Rechtsmittel, die insoweit durch das Adhäsionsverfahren entstandenen besonderen Kosten und die dem Neben- und Adhäsionskläger im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Auch hinsichtlich des Angeklagten O. A. wurde rechtzeitig ein Entschädigungsantrag gestellt (§ 404 Abs. 1 StPO). Zwar lässt sich aufgrund des Fehlens einer Zustellungsurkunde nicht nachweisen, dass der außerhalb der Hauptverhandlung gestellte Antrag vom 22. Januar 2013 dem Angeklagten auf Grund der Verfügung des Vorsitzenden vom 24. Januar 2013 persönlich zugestellt worden ist. Dieser Mangel wurde aber nach § 37 Abs. 1 StPO, § 189 ZPO geheilt, weil sich aus der Antragserwiderungsschrift vom 18. Februar 2013 zweifelsfrei ergibt, dass die mit einer umfassenden Zustellungsvollmacht versehene Verteidigerin des Angeklagten und damit eine Person, an die im Sinne von § 189 ZPO „die Zustellung dem Gesetz gemäß (...) gerichtet werden konnte", genaue Kenntnis von dem Entschädigungsantrag erhalten hat (vgl. BGH, Beschluss vom 20. Oktober 2011 - V ZB 131/11, Rn. 8).

Der Senat konnte die Adhäsionsentscheidung des Landgerichts ungeachtet des anderslautenden Antrags des Generalbundesanwalts im Beschlusswege aufrechterhalten, weil in Bezug auf die Schuld- und Straffrage die Voraussetzungen des § 349 Abs. 2 StPO vorliegen und sich aus § 406 Abs. 5 Satz 2, § 406a Abs. 2 Satz 2 StPO ergibt, dass das Rechtsmittelgericht ohne Hauptverhandlung entscheiden kann, wenn lediglich über die Zubilligung einer Entschädigung zu befinden ist (vgl. BGH, Beschluss vom 8. Juli 2009 - 2 StR 239/09, Rn. 4; Beschluss vom 27. September 2007 - 4 StR 324/07, Rn. 5; Beschluss vom 5. Januar 1999 - 3 StR 602/98, NStZ 1999, 260, 261).
