Résumé Omnilex

The Federal Court of Justice dismissed the defendant's revision against the Berlin Regional Court judgment. It held that when both a mitigated statutory sentencing range under § 49 StGB and the range for a lesser case may apply, the trial court must consider the issue in a comprehensive assessment but is not required to select the most favorable range for the accused. The doubt rule does not govern that choice. The appeal was therefore rejected under § 349 Abs. 2 StPO, with costs imposed on the appellant.

Regeste Omnilex

§§ 49, 50 StGB; sentencing framework selection where several mitigating grounds overlap: When a statutory mitigation under § 49 StGB and the framework for a lesser case are both conceivable, the trial court must examine the available sentencing ranges in a comprehensive overall assessment. It is, however, not compelled to adopt the framework most favorable to the defendant; the choice of sentencing framework is a matter of proper judicial discretion. The rule in dubio pro reo does not govern this selection (consid. 1).

Tenor

BGH, Urteile vom 3. Mai 1966 - 5 StR 173/66, BGHSt 21, 57, 59; vom 19. Januar 1982 - 1 StR 734/81, NStZ 1982, 200; Lackner/Kühl, StGB, 28. Aufl., § 50 Rn. 2; Schäfer/Sander/van Gemmeren, Praxis der Strafzumessung, 5. Aufl., Rn. 933; aA Theune in LK-StGB, 12. Aufl., § 50 Rn. 15 f.; Horn/Wolters, SK-StGB, 8. Aufl., § 50 Rn. 5; Fischer, StGB, 62. Aufl., § 50 Rn. 5). Der Zweifelssatz findet insofern keine Anwendung.

Question juridique clé

Whether the trial court had to choose the most favorable sentencing framework when § 49 StGB mitigation and a lesser case were both possible.

Solution extraite

The trial court must assess both possibilities in a global evaluation, but it is not obliged to apply the sentencing framework most favorable to the defendant; choosing the framework lies within its proper judicial discretion.

Motifs extraits

The court held that the doubt rule does not apply to the choice between a mitigated regular framework and the framework for a lesser case. The trial court's sentencing framework selection is reviewable only for legal error, not for failure to select the most lenient option.

Question juridique clé

The defendant's revision against the Berlin Regional Court judgment.

Solution extraite

The revision was unfounded.

Motifs extraits

No legal error in the sentencing framework selection was shown.
