The Federal Court of Justice dismissed the defendant's revision against the Lüneburg Regional Court judgment. It held that a new fact raised in the defendant's response, namely his return to work after release from pre-trial detention, did not prevent a decision under § 354(1a) StPO; the appellate court only had to consider that circumstance when assessing sentence adequacy. Even taking it into account, the imposed individual sentences and total term remained appropriate. The defendant bears the costs of the remedy, and the co-plaintiff receives no reimbursement of necessary expenses.

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Lüneburg vom 11. Februar 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen durchgreifenden Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2, § 354 Abs. 1a StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Eine Erstattung der dem Nebenkläger im Revisionsverfahren entstandenen notwendigen Auslagen findet nicht statt, da auch dessen Revision verworfen worden ist (vgl. Meyer-Goßner/Schmitt, StPO, 58. Aufl., § 473 Rn. 10a).

Ergänzend bemerkt der Senat:

Dass der Beschwerdeführer in seiner Gegenerklärung eine neue strafzumessungsrelevante Tatsache hat vorbringen lassen, hindert eine Entscheidung des Senats nach § 354 Abs. 1a StPO nicht. Der Vortrag neuer Tatsachen insoweit führt - ungeachtet der Frage, ob diese hätten glaubhaft gemacht werden müssen (vgl. dazu Paster/Sättele, NStZ 2007, 609, 613 einerseits und Gaede, GA 2008, 394, 406 andererseits) - lediglich dazu, dass das Revisionsgericht solche neuen Umstände bei seiner Entscheidung, ob die in dem angefochtenen Urteil verhängte Strafe angemessen ist, zu berücksichtigen hat (BGH, Beschluss vom 11. August 2009 - 3 StR 175/09, JR 2011, 177, 179 f. mit zust. Anmerkung Peglau; vgl. auch BeckOK StPO/Wiedner, § 354 Rn. 79; LR/Franke, StPO, 26. Aufl., § 354 Rn. 55; aA Gaede, StV 2011, 139, 141).

Auch unter Berücksichtigung des Umstandes, dass der Beschwerdeführer nach Entlassung aus der Untersuchungshaft wieder an seinem Arbeitsplatz tätig ist, erweisen sich die in dem angefochtenen Urteil verhängten Einzelstrafen sowie die Gesamtfreiheitsstrafe indes als angemessen.
