Unterbrechung der Hauptverhandlung: Überprüfungsmaßstab hinsichtlich der Wirksamkeit eines Hemmungsbeschlusses

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Berlin vom 9. Oktober 2015 wird mit der Maßgabe (§ 349 Abs. 4 StPO) nach § 349 Abs. 2 StPO als unbegründet verworfen, dass im Urteilstenor das Datum „5. November 2014“ durch „21. September 2015“ ersetzt wird.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Adhäsions- und Nebenklägerin durch seine Revision entstandenen notwendigen Auslagen zu tragen.

Ergänzend zum Antrag des Generalbundesanwalts bemerkt der Senat:

  1. Die Verfahrensbeanstandung, das Landgericht habe die Hauptverhandlung nach dem elften Verhandlungstag unter Überschreitung der dreiwöchigen Unterbrechungsfrist (§ 229 Abs. 1 StPO) in rechtsfehlerhafter Weise fortgesetzt, weil die Frist durch den Hemmungsbeschluss der Jugendschutzkammer nach § 229 Abs. 3 StPO nicht wirksam „unterbrochen“ worden sei, greift nicht durch. Im Blick auf § 229 Abs. 3 Satz 2, § 336 Satz 2 Alt. 1 StPO kommt insoweit eine Richtigkeitsprüfung über den Willkürmaßstab hinaus nicht in Betracht; sie ist auch verfassungsrechtlich nicht geboten (vgl. zur Entbindung vom Schöffenamt [§ 54 Abs. 1 GVG] BGH, Beschluss vom 5. August 2015 – 5 StR 276/15, StV 2015, 754 mwN; zudem LR-StPO/Becker, 26. Aufl., § 229 Rn. 43;

MüKo-StPO/Arnoldi, 2016, § 229 Rn. 26; KK-StPO/Gmel, 7. Aufl., § 229 Rn. 15; Graf/Gorf, StPO, 2. Aufl., § 229 Rn. 16). Anhaltspunkte dafür, dass die Voraussetzungen des § 229 Abs. 3 StPO für eine Hemmung überhaupt nicht vorgelegen haben, sind nicht ersichtlich.

  1. Betreffend die Rüge, ein auf die Einvernahme des Halbbruders der Geschädigten gerichteter Beweisantrag sei rechtsfehlerhaft abgelehnt worden, ist bereits zweifelhaft, ob dieser eine hinreichend konkretisierte Beweisbehauptung enthält.

  2. Zutreffend sieht der Generalbundesanwalt die Beanstandung, der Antrag auf Einvernahme der Zeugin M. sei rechtsfehlerhaft abgelehnt worden, als nicht den Anforderungen des § 344 Abs. 2 Satz 2 StPO entsprechend an. Im Übrigen ist die Ablehnungsbegründung des Landgerichts aber auch aus Rechtsgründen nicht zu beanstanden.

  3. Jedoch ist der Adhäsionsausspruch in der aus der Beschlussformel ersichtlichen Weise zu ändern, weil das Landgericht den Zeitpunkt der Rechtshängigkeit – wie es in den Urteilsgründen selbst ausgeführt hat (UA S. 55) – irrtümlich zum Nachteil des Angeklagten falsch tenoriert hat.
