The Federal Court of Justice rejected the defendant’s criminal revision against an Aachen Regional Court judgment. The regional court had convicted him of aggravated sexual abuse of children in 19 cases, sexual abuse of children in 84 cases, and sexual abuse of persons under special protection in eight cases, imposing an aggregate prison sentence of eight years and six months while acquitting him on the remaining counts. The Federal Court held that the factual findings and evidentiary assessment were still sustainable and that no reversible legal error was shown. Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Aachen vom 26. Februar 2015 wird als unbegründet verworfen.

Der Beschwerdeführer trägt die Kosten seines Rechtsmittels und die dem Nebenkläger hierdurch entstandenen notwendigen Auslagen.

Gründe

1 Das Landgericht hat den Angeklagten wegen schweren sexuellen Missbrauchs von Kindern in Tateinheit mit sexuellem Missbrauch von Schutzbefohlenen in 19 Fällen, wegen sexuellen Missbrauchs von Kindern in Tateinheit mit sexuellem Missbrauch von Schutzbefohlenen in 84 Fällen sowie wegen sexuellen Missbrauchs Schutzbefohlener in acht Fällen zu einer Gesamtfreiheitsstrafe von acht Jahren und sechs Monaten verurteilt und ihn im Übrigen freigesprochen. Seine hiergegen gerichtete Revision bleibt ohne Erfolg.

2 Der Schuldspruch beruht – wie schon der Generalbundesanwalt in seiner Zuschrift ausgeführt hat – auf einer noch tragfähigen Beweiswürdigung. Er weist im Übrigen keine Rechtsfehler zum Nachteil des Angeklagten auf. Dies gilt auch, soweit der Angeklagte in den Fällen 51, 62-63, 108 wegen schweren sexuellen Missbrauchs von Kindern (in Tateinheit mit sexuellem Missbrauch von Schutzbefohlenen) verurteilt worden ist, weil er das Tatopfer veranlasst hatte, in seinen Mund zu urinieren. Die gegen die Annahme des § 176a Abs. 2 Nr. 1 StGB vorgebrachten Bedenken (vgl. Eschelbach/Krehl, FS-Kargl, 2015, 81, 86 ff.) geben dem Senat keinen Anlass, seine Rechtsprechung (BGHSt 59, 263) zu ändern.
