The Bundesgerichtshof held that the auxiliary prosecutor’s revision against the LG Darmstadt judgment convicting the defendant of manslaughter was inadmissible. Under § 400 Abs. 1 StPO, an auxiliary prosecutor must make clear that the appeal seeks a change of the conviction concerning the auxiliary-prosecutor offense. A bare formal complaint and a general factual complaint are not enough. The revision was therefore rejected, and the auxiliary prosecutor had to bear the costs and the defendant’s necessary expenses.

Tenor

  1. Die Revision des Nebenklägers gegen das Urteil des Landgerichts Darmstadt vom 29. April 2015 wird als unzulässig verworfen.

  2. Der Beschwerdeführer hat die Kosten seines Rechtsmittels und die dem Angeklagten hierdurch entstandenen notwendigen Auslagen zu tragen.

Gründe

1 Das Landgericht hat den Angeklagten wegen Totschlags zu einer Freiheitsstrafe von sieben Jahren und sechs Monaten verurteilt. Hiergegen wendet sich die Revision des Nebenklägers mit der nicht ausgeführten Formalrüge und der in allgemeiner Form erhobenen Sachbeschwerde. Das Rechtsmittel erweist sich als unzulässig (§ 349 Abs. 1, § 400 Abs. 1 StPO).

2 Nach § 400 Abs. 1 StPO ist ein Nebenkläger nicht befugt, das Urteil mit dem Ziel anzufechten, dass eine andere Rechtsfolge der Tat verhängt oder der Angeklagte wegen einer Gesetzesverletzung verurteilt wird, die nicht zum Anschluss als Nebenkläger berechtigt. Ist der Angeklagte – wie hier – wegen eines nebenklagefähigen Delikts verurteilt worden, dann bedarf die Revision des Nebenklägers eines genauen Antrages oder einer Begründung, die deutlich macht, dass er eine Änderung des Schuldspruchs hinsichtlich des Nebenklagedelikts verfolgt (st. Rspr.; vgl. BGH, Beschluss vom 8. Dezember 2015 – 3 StR 445/15; Beschluss vom 25. November 2015 – 1 StR 349/15). Diese Voraussetzungen hat der Nebenkläger hier nicht erfüllt. Er hat seine Revision vielmehr allein mit der nicht ausgeführten Formalrüge und mit der in allgemeiner Form erhobenen Sachrüge begründet. Weitere Ausführungen, aus denen sich das Ziel des Rechtsmittels entnehmen ließe, sind bis zum Ablauf der Revisionsbegründungsfrist nicht eingegangen, so dass die Revision zu verwerfen ist.
