The Federal Labour Court dismissed the claimant’s revision against the Hessian Labour Court’s judgment. The court did not set out findings of fact or reasons because the parties had waived them pursuant to Section 313a ZPO. The only operative consequences were the dismissal of the revision and the allocation of the revision costs to the claimant.
§ 313a ZPO; waiver of statement of facts and reasons in the judgment: If the parties waive the statement of facts and the reasons, the court may issue a short-form judgment without a written factual recital or legal reasoning. In revision proceedings, if the appeal fails, the revising party bears the costs. The judgment is limited to the dispositive part and the cost order; no further reasons are required where the statutory prerequisites for a short-form judgment are met.
