The Federal Labor Court, on the defendant's revision, set aside the Baden-Württemberg Regional Labor Court's judgment and amended the Mannheim Labor Court's judgment to dismiss the claim. The claimant was ordered to bear the costs of the litigation. The decision was rendered without findings of fact or reasons because the parties waived them under Section 313a ZPO.
Art. 313a ZPO; waiver of findings of fact and reasons: if the parties validly waive the statement of facts and the reasons, the judgment may be issued in abbreviated form. Where the revision is successful, the Federal Labor Court may set aside the appellate judgment and, upon deciding the merits itself, dismiss the action and allocate costs accordingly; the dispositive part governs the operative effect of the judgment.

Der Kläger hat die Kosten des Rechtsstreits zu tragen.
