The Federal Labor Court, 8th Senate, dismissed the plaintiff’s revision against the judgment of the Sächsisches Landesarbeitsgericht. No substantive reasons were set out because the parties waived findings of fact and reasons. The only express consequence was that the plaintiff had to bear the costs of the revision.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO; where the parties waive findings of fact and reasons, the appellate court may render a shortened judgment form. If the revision is dismissed, the revision costs are borne by the unsuccessful revising party.
