In a revision proceeding concerning an additional gross wage difference of EUR 134.62 for February and April 2010, the employer acknowledged the claim. The Federal Labour Court therefore entered an acknowledgment judgment, set aside the appellate judgment, amended the first-instance judgment in the challenged parts, and ordered the defendant to pay the claimed amount plus interest from 1 June 2010. The defendant was also ordered to bear the costs of the litigation.
§ 307 Satz 1 ZPO; acknowledgment in revision proceedings; if the defendant acknowledges the claim and the plaintiff requests an acknowledgment judgment, the court must decide according to the acknowledgment, provided the claim is procedurally capable of judgment. The acknowledgment replaces adjudication on the merits; the court need not examine the substantive dispute further. Costs follow § 91 ZPO against the acknowledging party.

Auf die Revision der Klägerin wird das Urteil des Landesarbeitsgerichts Düsseldorf vom 11. Juli 2011 - 14 Sa 1812/10 - aufgehoben.
Auf die Berufung der Klägerin wird das Urteil des Arbeitsgerichts Essen vom 28. Oktober 2010 - 1 Ca 2173/10 - in seinen Ziffern 2 und 3 abgeändert und die Beklagte verurteilt, an die Klägerin weitere 134,62 Euro brutto nebst Zinsen hieraus iHv. fünf Prozentpunkten über dem Basiszinssatz seit dem 1. Juni 2010 zu zahlen.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
1 I. Die Parteien streiten - soweit für die Revision von Belang - über eine weitere Vergütungsdifferenz für die Monate Februar und April 2010.

Die Klägerin hat zuletzt sinngemäß beantragt,

3 Das Arbeitsgericht hat insoweit die Klage abgewiesen. Das Landesarbeitsgericht hat die Berufung der Klägerin zurückgewiesen. Mit der vom Landesarbeitsgericht zugelassenen Revision verfolgt die Klägerin ihren Klageantrag weiter.
4 Die Beklagte hat im Revisionsverfahren mit Schriftsatz vom 29. Juni 2012 den Klageanspruch anerkannt. Daraufhin hat die Klägerin den Erlass eines Anerkenntnisurteils beantragt.
5 II. Die zulässige Revision ist begründet. Aufgrund des Anerkenntnisses der Beklagten ist sie dem Anerkenntnis gemäß zu verurteilen, § 307 Satz 1 ZPO.

III. Die Beklagte hat gemäß § 91 ZPO die Kosten des Rechtsstreits zu tragen.
