The Federal Labor Court decided a revision in a labor dispute after the parties had waived findings of fact and reasons because of a leading parallel case. The defendant's revision against the judgment of the Hessian Regional Labor Court was dismissed. The court also ordered the defendant to bear the costs of the revision.
§ 72 Abs. 5 ArbGG, § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO; waiver of findings of fact and reasons in a revision decision where the parties refer to a leading parallel case. If the parties waive a statement of facts and reasons in view of a parallel leading proceeding, the court may decide accordingly without a full factual statement and reasoning under the cited provisions; the revision is then disposed of by summary rejection, with costs following the outcome of the revision.
