The Federal Labour Court dismissed the defendant state's revision against the judgment of the Berlin-Brandenburg Regional Labour Court. The court's disposition contains no factual recitation because the parties waived the statement of facts and reasons under Section 313a(1) ZPO. The only operative consequence expressly stated is that the defendant state must bear the costs of the revision.
