The Federal Labour Court dismissed the claimant's revision against the judgment of the Hessian Labour Court. The court noted that, in light of a parallel proceeding (4 AZR 50/13), the parties had waived a statement of facts and reasons under the relevant procedural provisions. The only operative part is the dismissal of the revision and the allocation of revision costs to the claimant.

Where the parties validly dispense with the statement of facts and reasons, the appellate court may issue a shortened judgment without detailed reasoning. In such a constellation, the Federal Labour Court may likewise decide the revision by concise operative ruling; the absence of reasons does not affect the validity of the judgment if the statutory prerequisites are met.
