The Federal Court of Justice dealt with a revision in a civil dispute concerning the validity of a company agreement. After the plaintiff had been warned that the revision was hopeless and then withdrew it, the court declared the remedy forfeited. It also ordered the plaintiff to bear the costs of the revision.

Tenor

Die auf die Nichtigkeit ihres Gesellschaftsvertrages (§ 134 BGB, Art. 1 § 1 Abs. 1 Satz 1 RBerG) und die Aussichtslosigkeit ihres Rechtsmittels (vgl. Senatsurteil vom 30. Oktober 2012 - XI ZR 324/11, WM 2012, 2322 Rn. 11 ff.; BGH, Beschlüsse vom 19. Juli 2011 - II ZR 86/10, - II ZR 87/10 und - II ZR 88/10, jeweils juris) vorab hingewiesene Klägerin wird, nachdem sie die Revision gegen das am 27. November 2012 verkündete Urteil des 1. Zivilsenats des Oberlandesgerichts Düsseldorf zurückgenommen hat, dieses Rechtsmittels für verlustig erklärt.

Die Kosten der Revision werden ihr auferlegt (§§ 565, 516 Abs. 3 ZPO).

Streitwert: 4.762.202,90 € (§ 47 Abs. 1 Satz 1 GKG).
