The Federal Court of Justice rejected the claimant's application against a prior Senate cost order. It held that no unified cost decision was necessary because, when both parties' appeals are unsuccessful, each appeal may be assessed separately for costs. The application was therefore dismissed under § 97 ZPO.
§ 97 ZPO; separate cost assessment where both parties' remedies are unsuccessful: if appeals or other legal remedies fail on both sides, the court is not obliged to issue a single unified cost allocation. Rather, each remedy may be assessed independently for costs (consid. 1). The choice of a separate cost treatment does not require further justification once the mutual lack of success is established.

1 Eine einheitliche Kostenentscheidung war nicht veranlasst. Bei Erfolglosigkeit beiderseitiger Rechtsmittel kann jedes dieser Rechtsmittel kostenmäßig gesondert beurteilt werden (Baumbach/Lauterbach/Albers/Hartmann, 71. Aufl. § 97 ZPO Rn. 36).
