Tenor

Der Senat tritt der Rechtsansicht des anfragenden 3. Strafsenats bei, dass es für die Verurteilung wegen vollendeter Hehlerei (§ 259 Abs. 1 StGB) durch Absetzen der Feststellung eines Absatzerfolges bedarf.

Entgegenstehende eigene Rechtsprechung gibt der Senat auf.

Gründe

1 Der Senat stimmt im Grundsatz der Auffassung des anfragenden 3. Strafsenats zu, dass eine auf die Vornahme dieser Tathandlung gestützte Verurteilung wegen vollendeter Hehlerei die Feststellung eines Absatzerfolges voraussetzt. Dabei bedurfte es im Hinblick auf die Fragestellung keiner näheren Vertiefung, welche Anforderungen an einen solchen Absatzerfolg zu stellen sein werden (vgl. dazu etwa T. Walter in LK-StGB, 12. Aufl., § 259 Rn. 51 ff.).

2 Da der Anfragebeschluss des 3. Strafsenats lediglich das Merkmal „absetzt“ betrifft, braucht sich der Senat auch nicht dazu zu verhalten, ob das Erfordernis eines - wie auch immer gearteten Absatzerfolges - für das Tatbestandsmerkmal „absetzen hilft“ in § 259 Abs. 1 StGB ebenfalls zu gelten hätte. Der Senat weist im Hinblick auf den Gegenstand der Anfrage zudem klarstellend darauf hin, dass die Aufgabe früherer eigener, der Rechtsansicht des anfragenden 3. Strafsenats entgegenstehender Rechtsprechung lediglich zu dem Merkmal „absetzt“ in § 259 Abs. 1 StGB ergangene Entscheidungen nicht aber - wie die Bezugnahme im Anfragebeschluss auf die Senatsentscheidung vom 15. April 1980 (5 StR 135/80) nahelegen könnte - Rechtsprechung des Senats zu dem Merkmal „absetzt“ in § 374 Abs. 1 AO (Steuerhehlerei) betrifft.
