The complainant requested legal aid and counsel for a constitutional complaint against a decision of the Higher Regional Court of Saxony-Anhalt. The Federal Constitutional Court held that the complaint had no sufficient prospects of success because it was inadmissible. It therefore refused legal aid and did not admit the complaint for decision. The order is final and not appealable.
§ 114 S. 1 ZPO; legal aid for a constitutional complaint may be refused when the intended proceeding lacks sufficient prospects of success. If the constitutional complaint is inadmissible, the requirement of success prospects is absent. § 90 BVerfGG; an inadmissible constitutional complaint is not admitted for decision. The refusal of legal aid may be based solely on the evident lack of admissibility and thus of any substantive chance of success.
