The Federal Constitutional Court, First Chamber of the First Senate, did not accept the constitutional complaint for decision. It relied on a parallel chamber decision of 29 May 2012 and expressly dispensed with further reasoning under § 93d(1) sentence 3 BVerfGG. The complaint therefore failed at the admissibility/acceptance stage; the decision is unappealable.
§ 93d Abs. 1 Satz 3 BVerfGG; non-acceptance of a constitutional complaint without further reasons. Where a chamber does not accept a constitutional complaint for decision and refers to a parallel decision, it may abstain from any further reasoning pursuant to § 93d Abs. 1 sentence 3 BVerfGG. The non-acceptance disposition is final and not subject to appeal.
