The Federal Constitutional Court, sitting as a chamber, did not admit the constitutional complaint against the revocation of a driving licence following mixed alcohol and cannabis use. The complaint was rejected without reasons under § 93d(1) sentence 3 BVerfGG. The challenged judgments of the Administrative Court Regensburg and the Federal Administrative Court remained untouched.
§ 93d Abs. 1 S. 3 BVerfGG; non-admission of a constitutional complaint without reasons. A chamber may refuse to admit a constitutional complaint by unanalyzed order if the statutory admission requirements are not met. In such a case, the Court need not set out substantive constitutional review of the underlying administrative-court judgments; the non-admission order leaves the lower-court decisions in force. The decision is procedural and does not contain a merits assessment of the contested measure.
