The Federal Constitutional Court refused to admit a prisoner’s constitutional complaint. Although the complainant argued that repeated transfers and the alleged inactivity of eight regional courts might raise concerns in light of his resocialization interest, the filing did not present an examinable factual record. The complaint and attachments contained no sufficient details about the underlying proceedings or the transfer to JVA Würzburg. Because the complaint lacked the reasoning required by §§ 92 and 23(1) sentence 2 BVerfGG, legal aid was denied and the request for interim relief became moot.

Tenor

Der Antrag auf Bewilligung von Prozesskostenhilfe und Beiordnung von Rechtsanwalt S. wird abgelehnt, weil die beabsichtigte Rechtsverfolgung keine hinreichende Aussicht auf Erfolg bietet.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Damit erledigt sich der Antrag auf Erlass einer einstweiligen Anordnung.

Gründe

1 Die Verfassungsbeschwerde, mit der der Beschwerdeführer die Untätigkeit von acht Landgerichten rügt und auf seine Verlegung in die Justizvollzugsanstalt Würzburg vom 3. November 2014 verweist, wird gemäß § 93a Abs. 2 BVerfGG nicht zur Entscheidung angenommen, weil sie keine Aussicht auf Erfolg hat (vgl. BVerfGE 90, 22 <24>; 96, 245 <248>; BVerfGK 12, 189 <196>). Sie genügt nicht den Begründunganforderungen der §§ 92, 23 Abs. 1 Satz 2 BVerfGG (vgl. BVerfGE 108, 370 <386 f.>).

2 1. Zwar könnte der Umstand, dass der Beschwerdeführer - seinen Vortrag als richtig unterstellt - nach den zahlreichen, aus früheren Verfassungsbeschwerdeverfahren bekannten Verlegungen am 3. November 2014 erneut in eine andere Justizvollzugsanstalt verlegt worden ist, im Hinblick auf seinen Resozialisierungsanspruch verfassungsrechtlich bedenklich sein (vgl. BVerfGK 6, 260 <264>; 8, 307 <309>).

3 2. Die Verlegung ist im vorliegenden Verfahren jedoch nicht überprüfbar. Es fehlt bereits an der Darstellung eines entscheidungsfähigen Sachverhalts. Weder zu den acht landgerichtlichen Verfahren, in denen der Beschwerdeführer Untätigkeit rügt, noch zu seiner Verlegung in die Justizvollzugsanstalt Würzburg sind der Verfassungsbeschwerdeschrift oder ihren Anlagen Einzelheiten zu entnehmen, die einer Prüfung zugänglich wären.

4 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

5 Diese Entscheidung ist unanfechtbar.
