The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant, who alleged a violation of the right to be heard, had failed to exhaust legal remedies because no hearing complaint had been filed against the Higher Regional Court's decision. The complaint was therefore inadmissible in full on subsidiarity grounds. In addition, the filing did not satisfy the statutory substantiation requirements because the constitutional violation was not made comprehensible and essential documents were missing. The pending request for interim relief became moot.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Mit der Nichtannahme der Verfassungsbeschwerde wird der Antrag auf Erlass einer einstweiligen Anordnung gegenstandslos (§ 40 Abs. 3 GOBVerfG).

Gründe

1 Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen. Die Verfassungsbeschwerde ist unzulässig. Die Beschwerdeführerin rügt ausdrücklich eine Verletzung rechtlichen Gehörs (Art. 103 Abs. 1 GG), ohne aber gegen den Beschluss des Oberlandesgerichts eine Anhörungsrüge erhoben zu haben, was insoweit zur Erschöpfung des Rechtswegs erforderlich gewesen wäre (§ 90 Abs. 2 Satz 1 BVerfGG). Da auch die weiteren von der Beschwerdeführerin gerügten Grundrechtsverstöße denselben Streitgegenstand betreffen, wie die der Sache nach geltend gemachte Gehörsverletzung, ist die Verfassungsbeschwerde insgesamt schon wegen der Subsidiarität der Verfassungsbeschwerde unzulässig (vgl. BVerfGE 134, 106 <113>).

2 Zudem genügt die Verfassungsbeschwerde nicht den Anforderungen der § 23 Abs. 1 Satz 2 Halbsatz 1, § 92 BVerfGG. Ihre Begründung lässt eine Verletzung von Rechten im Sinne des § 90 Abs. 1 BVerfGG inhaltlich nicht nachvollziehbar erkennen, zumal wesentliche, für die Beurteilung des Sachverhalts notwendige Unterlagen nicht vorgelegt worden sind (zu den Substantiierungsanforderungen vgl. nur BVerfGE 78, 320 <329>; 99, 84 <87>; 115, 166 <179 f.>; 130, 1 <21>; stRspr).

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
