Résumé Omnilex

The Federal Constitutional Court's First Chamber of the Second Senate did not admit the constitutional complaint against the German Bundestag's Armenia resolution. The complaint was held inadmissible because the complainant failed to sufficiently substantiate the possibility that his fundamental rights or equivalent rights had been violated; no such violation was otherwise apparent. The decision is final and not subject to appeal.

Regeste Omnilex

Art. 93 para. 1 no. 4a GG; §§ 23 para. 1 sentence 2, 90, 92, 93d para. 1 sentence 3 BVerfGG; constitutional complaint against a parliamentary resolution is inadmissible if the complainant does not sufficiently substantiate a possible violation of fundamental rights or rights equivalent to fundamental rights. The constitutional complaint must identify, with sufficient detail, the challenged act, the possibly infringed rights, and the manner in which the alleged violation may arise; a mere assertion is insufficient. If such substantiation is lacking, the complaint is not admitted to decision; the Chamber may reject it without reasons under § 93d para. 1 sentence 3 BVerfGG.
