Résumé Omnilex

The Federal Constitutional Court did not admit a constitutional complaint concerning a planned Bavarian referendum on leaving the Federal Republic. It held in the tenor that, as the Federal Republic is a state based on the constituent power of the German people, the Länder are not masters of the Basic Law and have no room under it for secessionist efforts. Such efforts violate the constitutional order. The decision is final.

Regeste Omnilex

Art. 20 Abs. 2, 3 GG; Art. 28 GG; § 90, § 93d Abs. 1 S. 3 BVerfGG; secessionist efforts of a Land are incompatible with the constitutional order and cannot be pursued under the Basic Law. The Länder are not holders of constituent power in relation to the Basic Law and are not entitled to unilateral withdrawal from the Federation. A constitutional complaint directed against such secessionist aims is not to be admitted for decision.
