Résumé Omnilex

The First Senate's Third Chamber did not accept the constitutional complaint. It acknowledged that the labour court had not sufficiently balanced freedom of expression against personal honour and the economic freedom of the opposing party, but held that acceptance was still unwarranted because the complainant would have failed even under a proper balancing of interests. The Court also set the value of the subject matter for the lawyer’s work at EUR 5,000.

Regeste Omnilex

Art. 5 Abs. 1 and 2 GG; § 93a Abs. 2 BVerfGG: A constitutional complaint may be refused acceptance even where the impugned decision lacks the constitutionally required balancing between freedom of expression and personal honour, if it is already clearly foreseeable that the complainant would not succeed on remittal because, on the concrete circumstances, freedom of expression would have to yield. For the assessment of acceptance, the decisive point is whether a particularly serious disadvantage exists; mere error in the balancing exercise is insufficient where the outcome would remain unchanged. § 37 Abs. 2 sentence 2 in conjunction with § 14 Abs. 1 RVG governs the determination of the subject-matter value in constitutional complaint proceedings.

Titelzeile

Question juridique clé

Whether the constitutional complaint should be accepted for decision under § 93a BVerfGG despite errors in balancing freedom of expression and personal honour.

Solution extraite

The complaint was not accepted because no particularly serious disadvantage was shown; it was foreseeable that the complainant would still lose even after proper balancing.

Motifs extraits

Although the Labour Court's reasoning was constitutionally insufficient because it treated the statements as insults and smear criticism without the required balancing, acceptance was still unnecessary. On the concrete facts, freedom of expression would have to yield to the interests of the opposing party even after a constitutionally proper balancing.

Question juridique clé

Whether the value of the subject matter for the attorney's work in the constitutional complaint proceedings should be set.

Solution extraite

The value of the subject matter was set at EUR 5,000.

Motifs extraits

The Court based the valuation on § 37(2) sentence 2 in conjunction with § 14(1) RVG.
