The Federal Constitutional Court rejected the application for legal aid and appointment of counsel in a constitutional complaint challenging several OVG Lüneburg decisions concerning § 25 Abs. 5 AufenthG. Tenor

Der Antrag auf Bewilligung von Prozesskostenhilfe und Beiordnung des Rechtsanwalts S… wird abgelehnt, weil die beabsichtigte Rechtsverfolgung keine hinreichende Aussicht auf Erfolg bietet.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen. Zwar hat das Oberverwaltungsgericht mit seiner Auffassung, Zeiten eines nur geduldeten Aufenthalts seien bei der Interessenabwägung nach § 25 Absatz 5 Aufenthaltsgesetz nicht zu berücksichtigen und deshalb Zweifel an der Rechtsauffassung des Verwaltungsgerichts nicht dargetan, die Anforderungen an die Zulassung der Berufung in einer Verfassungsrecht verletzenden Weise überspannt, doch setzt sich die Verfassungsbeschwerde nicht mit allen die angegriffenen Entscheidungen selbstständig tragenden Erwägungen hinreichend auseinander, so dass sie unzulässig ist.

Diese Entscheidung ist unanfechtbar.
