1 Die Beschwerde hat Erfolg. Der Rechtssache kommt die vom Kläger geltend gemachte grundsätzliche Bedeutung zu (§ 132 Abs. 2 Nr. 1 VwGO). Im Revisionsverfahren wird voraussichtlich zu klären sein, ob es die in Art. 28 Abs. 1 Satz 2 GG garantierten Wahlrechtsgrundsätze der Unmittelbarkeit, der Allgemeinheit und/oder der Gleichheit der Wahl verbieten, dass eine Vorschrift des Landeskommunalrechts die Gemeindevertretung ermächtigt, einem gewählten Mitglied der Gemeindevertretung, das straffällig geworden ist, durch Mehrheitsbeschluss nach seinem Ermessen das Mandat zu entziehen.
