Résumé Omnilex

The Federal Administrative Court upheld a complaint against the Higher Administrative Court's refusal to admit revision in a weapons-law dispute. It held that the case has fundamental significance because the revision can clarify the legal effects of alcohol consumption on reliability and personal suitability under weapons law. The court set the dispute value at EUR 11,750 for the complaint proceedings and provisionally for the revision proceedings. Costs were left to the outcome of the main case.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admission for fundamental significance in weapons law: A complaint against denial of leave to appeal succeeds where the case raises a general legal question requiring clarification in revision. Fundamental significance exists if the revising court may develop or refine the assessment of how alcohol consumption affects reliability and personal suitability under weapons law. The costs of the leave-to-appeal proceedings follow the merits decision; the dispute value is to be fixed separately under the GKG provisions cited in the order.
