Leitsatz 1a

§§ 277, 278 ABGB Art 4 Abs 1 RFVG Art 92, 103 LVG

Die Parteistellung einer Person im Rechtsfürsorgeverfahren setzt voraus, dass diese in ihren rechtlich geschützten Interessen und damit in ihrer eigenen Rechtssphäre betroffen ist. Auch im Rechtsfürsorgeverfahren ist das Vorhandensein einer "Beschwer" besondere Voraussetzung für die Zulässigkeit eines Rechtsmittels. Die Beschwer muss sich aus dem Spruch der angefochtenen E ableiten lassen. Die Beschwer ist ein objektives Zulässigkeitserfordernis für jedes Rechtsmittel und hängt nicht von der subjektiven Einschätzung des Rechtsmittelwerbers ab.

Ein rechtlich geschütztes Interesse ehemaliger Verwaltungsräte daran, welche Person als Kurator für die angeblich geschädigte Verbandsperson deren angebliche Ansprüche (auch) gegen diese Verwaltungsräte zu prüfen und allenfalls durchzusetzen hat, besteht nicht.

Eine (gelöschte) Stiftung, für die ein Kurator über Antrag eines Begünstigten (oder Gläubigers) bestellt werden soll, muss schon im Verfahren zur Bestellung dieses Kurators durch einen Kurator bzw Beistand vertreten und beteiligt sein.
