ORDER

This matter arises under the Migrant and Seasonal Agricultural Worker Protection Act of 1983
(“MSPA”), 29 U.S.C. § 1801, et seq., and the implementing regulations at 29 C.F.R. Part 500.
Respondent made a timely request for an administrative hearing to review the Administrator’s
assessment against Respondent under the MSPA. An Order of Reference was filed with the
Department of Labor’s Office of Administrative Law Judges (OALJ) on September 19, 2025. This
case was assigned to a presiding judge on September 2, 2026. It is scheduled for a formal hearing
on October 26, 2026, at 9:30 a.m. Eastern time by video conference (Microsoft Teams). A
prehearing telephonic conference is scheduled for October 16, 2026, at 1:00 p.m. Eastern time.*

On October 13, 2026, the Administrator, Wage and Hour Division (WHD), U.S. Department of
Labor (“the Administrator”) filed a Motion for Summary Decision, or in the Alternative, Partial
Motion for Summary Decision as to Liability Against Respondent Bernard Carter. The motion was
accompanied by a brief in support, a statement of undisputed material facts, and Exhibits 1-7.

Due to the expedited nature of this proceeding, Respondent is ORDERED to file any response to
the Administrator’s motion by October 20, 2026. The response must be received by this tribunal
by October 20, 2026. To ensure timely receipt, Respondent may file his response by PDF
attachment sent to: OALJ-NewportNews@DOL.GOV

The other deadlines established in the Notice of Assignment and Notice of Hearing and
Scheduling Order remain in effect.
