1 (Appellee). We previously issued a notice of proposed summary disposition in which
2 we proposed to affirm. Appellant has filed a responsive document indicating that he
3 has determined not to proceed further with the appeal, and will not file a
4 memorandum in opposition.

6 summary disposition, we affirm.
