No. 04-26-00748-CV
Elizabeth Gamez HERNANDEZ,
Appellant
v.
Dinorah Bravo SERNA, Lyanna Z. Bravo Traylen, and James Edward Bravo, III,
Appellees
From the 406th Judicial District Court, Webb County, Texas
Trial Court No. 2026CVG000375-D4
Honorable David E. Garcia, Judge Presiding
O R D E R
This is an accelerated appeal from an order granting a temporary injunction. The notice
of appeal, dated September 29, 2026, states that appellant is appealing from an August 28, 2026
order.
Accelerated appeals must be filed within 20-days following the complained-of order or
judgment is signed. See TEX. R. APP. P. 26.1(b). Appellant’s notice of appeal is thus untimely. A
motion for extension of time is necessarily implied when an appellant, acting in good faith, files
a notice of appeal beyond the time allowed by Rule 26.1 but within the fifteen-day grace period
provided by Rule 26.3 for filing a motion for extension of time. See Verburgt v. Dorner, 959
S.W.2d 615, 617 (Tex. 1997) (construing the predecessor to Rule 26). However, the appellant
must provide a reasonable explanation for failing to file the notice of appeal in a timely manner.
See id.; TEX. R. APP. P. 26.3, 10.5(b)(1)(C).
Appellant responded that her counsel was prevented from timely filing a notice of appeal
and from filing a motion for extension of time due to a mistaken understanding of the law.
Appellant’s explanation is reasonable and shows good faith. We therefore imply a motion for
extension of time, grant it, and deem the notice of appeal timely filed.
It is so ORDERED on October 20, 2026.
PER CURIAM
