Le présent Accord porte sur les mesures adoptées ou maintenues par les Parties concernant les produits agricoles: (a) relevant des chap. 1 à 24 du Système harmonisé de désignation et de codification des marchandises5(ci-après dénommé «SH») et qui ne figurent pas dans les annexes II ou III de l’accord de libre-échange; et (b) visés par l’annexe I de l’accord de libre-échange.
L’Ukraine accorde des concessions tarifaires aux produits agricoles originaires de Suisse aux termes de l’annexe I. La Suisse accorde des concessions tarifaires aux produits agricoles originaires d’Ukraine aux termes de l’annexe II.
Les Parties examinent les difficultés susceptibles d’émaner de leurs échanges de produits agricoles et œuvrent à rechercher des solutions adéquates.
Les Parties s’engagent à poursuivre leurs efforts en vue d’une libéralisation accrue de leurs échanges de produits agricoles, tout en tenant compte de la structure de leurs relations commerciales dans ce domaine, de la sensibilité particulière de ces produits et du développement de leur politique agricole respective. A la demande de l’une des Parties, les Parties se consultent sur la façon d’atteindre cet objectif, y compris en améliorant l’accès au marché par la réduction ou la suppression des droits de douane sur les produits agricoles et par l’extension du champ d’application des produits agricoles couverts par le présent Accord.
Les dispositions suivantes de l’accord de libre-échange s’appliquentmutatis
mutandis entre les Parties au présent Accord: art. 1.4 (Application territoriale),
1.5 (Gouvernements centraux, régionaux et locaux), 1.6 (Transparence), 2.6 (Restrictions à l’importation et à l’exportation), 2.8 (Mesures sanitaires et phytosanitaires), 2.9 (Réglementations techniques), 2.12 (Entreprises commerciales d’Etat), 2.16 (Mesures de sauvegarde bilatérales), 2.17 (Exceptions générales), 2.18 (Exceptions concernant la sécurité), et le chap. 9 (Règlement des différends).
En foi de quoi, les soussignés, dûment autorisés à cet effet, ont signé le présent Accord.Fait à Reykjavik, le 24 juin 2010, en deux exemplaires originaux en langue anglaise.

1. Les droits frappant les importations en Ukraine de produits originaires de Suisse et énumérés dans le tableau dans la catégorie «0» sont supprimés à compter du 1erjanvier 2012.
2. Les droits frappant les importations en Ukraine de produits originaires de Suisse et énumérés dans le tableau dans la catégorie «3» sont progressivement supprimés selon le calendrier suivant: – le 1erjanvier 2012, ils sont portés à 75 % du droit de base, – le 1erjanvier 2013, ils sont portés à 50 % du droit de base, – le 1erjanvier 2014, ils sont portés à 25 % du droit de base, – le 1erjanvier 2015, les droits restants sont supprimés.
3. Les droits frappant les importations en Ukraine de produits originaires de Suisse et énumérés dans le tableau dans la catégorie «5» sont progressivement supprimés selon le calendrier suivant: – le 1erjanvier 2012, ils sont portés à 83 % du droit de base, – le 1erjanvier 2013, ils sont portés à 67 % du droit de base, – le 1erjanvier 2014, ils sont portés à 50 % du droit de base, – le 1erjanvier 2015, ils sont portés à 34 % du droit de base, – le 1erjanvier 2016, ils sont portés à 17 % du droit de base, – le 1erjanvier 2017, les droits restants sont supprimés.
4.
