6 CAR § 230-101 Definitions {#sec-6-car-230-101 omnilex-key=us-ar-regs-official--title-6-part-230--6 CAR § 230-101}

6 CAR § 230-101. Definitions.

As used in this part:

(1) "Division" means the Division of Elementary and Secondary Education of the Department of Education;

(2) "State board" means the State Board of Education; and

(3) “Waiver” means a waiver granted by the State Board of Education pursuant to its authority under Arkansas Code § 6-15-103.

6 CAR § 230-102 Requests for waiver {#sec-6-car-230-102 omnilex-key=us-ar-regs-official--title-6-part-230--6 CAR § 230-102}

6 CAR § 230-102. Requests for waiver.

(a)(1) A school district may petition the State Board of Education for all or some of the waivers granted to an open-enrollment public charter school.

(2) Prior to requesting a waiver, the school district board of directors must adopt a resolution authorizing the request for the waiver.

(b)(1) Districts may only request waivers that:

(A) Enhance student learning opportunities;

(B) Promote innovation; or

(C) Increase equitable access to effective teachers.

(2) Waivers requested for the sole purpose to avoid violations of the Standards for Accreditation of Arkansas Public Schools and School Districts, 6 CAR pt. 61 shall not be granted.

(c) The petition shall include without limitation:

(1) The name of the open-enrollment public charter school that holds the waiver or waivers;

(2) A list of the waiver or waivers that the district seeks to have granted, including:

(A) The proposed standards for accreditation;

(B) The proposed Division of Elementary and Secondary Education rules; and

(C) The proposed statutes of the Arkansas Code;

(3) The proposed duration of the requested waiver or waivers;

(4) A signed copy of the resolution adopted by the school district's board of directors authorizing the district to request the waiver;

(5) Evidence of stakeholder involvement, including teachers and student families;

(6) The grades, schools, and classes to which the proposed waiver or waivers apply; and

(7) A detailed rationale for the request, including but not limited to:

(A) How the waiver or waivers:

(i) Enhance student learning opportunities;

(ii) Promote innovation; or

(iii) Increase equitable access to effective teachers;

(B) How students will be served; and

(C) How the district will monitor and evaluate the effectiveness of the waiver.

(d) The petition must be submitted to the Office of Legal Services on the approved request form which shall be available on the division’s website.

(e) A district may not request and the state board may not grant waivers of any of the following:

(1) Monitoring compliance with Title 6 of the Arkansas Code, as determined by the Commissioner of Elementary and Secondary Education;

(2) Public school accountability under Title 6 of the Arkansas Code;

(3) High school graduation requirements as established by the state board;

(4) Special education programs as provided by Title 6 of the Arkansas Code;

(5) Conducting criminal background checks for employees as provided by Title 6 of the Arkansas Code;

(6) Health and safety codes as established by the state board and local governmental entities;

(7) Arkansas qualified teacher requirements;

(8) Ethical guidelines and prohibitions as established by:

(A) Arkansas Code § 6-24-101 et seq.; and

(B) Any other controlling state or federal law regarding ethics or conflicts of interest;

(9) Reporting through the Arkansas Public School Computer Network applications as provided under Title 6 of the Arkansas Code; and

(10) The school start date set forth in Arkansas Code § 6-10-106.

(f) A district may request a waiver of the requirements of Arkansas Code § 6-16-102(a)(5) concerning recess only if the district submits to the division for approval of an alternative plan for recess that:

(1) Exceeds the required minimum amount of minutes combined for:

(A) Physical activity under Arkansas Code § 6-16-132; and

(B) Recess under Arkansas Code § 6-16-102(a); and

(2) Provides for both structured and unstructured social time.

(g)(1) Districts shall have the opportunity to amend their request until fifteen (15) days prior to the state board’s consideration of the waiver request.

(2) If a district wishes to amend its request after the timeline in subdivision (g)(1) of this section, it may only do so at the waiver hearing.

6 CAR § 230-103. Hearing.

(a) All waiver requests shall be presented to the State Board of Education.

(b) All persons, with exception of the attorneys representing the parties, who plan to provide testimony during the hearing must be sworn by the Chair of the State Board of Education.

(c)(1)(A) The district shall have twenty (20) minutes to present its case to the state board for approval of the proposed waivers.

(B) The chair may grant additional time if necessary.

(2) If the district intends to use a presentation, handouts, or any other document, it must provide copies to the Office of Legal Services no later than ten (10) business days prior to the hearing.

(3) If the district does not provide materials as required by subdivision (c)(2) of this section, it may only use a presentation or present additional documents with the permission of the state board.

(d)(1)(A) Parties opposed to the proposed waivers, if any, shall have twenty (20) minutes to present their case to the state board.

(B) The chair may grant additional time if necessary.

(2) Any party in opposition that wishes to present or participate at the hearing must notify the office and the district requesting the waiver in writing no later than ten (10) business days prior to the hearing.

(3) If a party in opposition intends to use a presentation, handouts, or any other document, it must provide copies to the office and to the district requesting the waiver no later than ten (10) business days prior to the hearing.

(4) A party in opposition that fails to provide notice as required by subdivision (d)(2) and (3) of this subsection may only present or participate at the hearing with the permission of the state board.

(5) If there are multiple individuals or groups who wish to speak in opposition, it is the responsibility of those individuals or groups to divide the twenty (20) minutes between themselves.

(e)(1) The district shall have five (5) minutes to respond to any arguments in opposition to the proposed waivers.

(2) The chair may grant additional time if necessary.

(f) The state board will follow the presentations with discussion of the proposed waivers and may ask questions to:

(1) Any of the parties;

(2) The Division of Elementary and Secondary Education; or

(3) Both.

(g) The state board may ask questions at any time during the presentation by the district or the opposing parties.

(h)(1) The state board may grant, in whole or in part, or deny, in whole or in part, the proposed waivers.

(2) The state board may also take the matter under advisement until a future scheduled state board meeting.

(3) The state board must make a decision within ninety (90) days of receiving the waiver request.

(i)(1) Any waiver or waivers granted to a district, in whole or in part, are valid for the duration requested by the district unless the state board votes otherwise.

(2) The waiver or waivers shall not exceed the duration that the waiver is valid for the open-enrollment public charter school on which the request was based.

(3) The waiver or waivers shall not be granted for a period of time exceeding five (5) years.

(4) If a district wishes to renew a waiver that is expiring, it must follow the procedure set out in 6 CAR § 230-105 of this part.

(j) The state board may request annual reporting as a condition of approval of the proposed waiver or waivers.

(k) The division shall notify the superintendent of the district in writing of the decision of the state board.

(l) All waivers granted under this part shall be posted to the division's website.

(m) The district must post all waivers granted under this part to the district's website under “State-Required Information” within thirty (30) days of the state board’s approval.

6 CAR § 230-104 Review and revocation of waivers {#sec-6-car-230-104 omnilex-key=us-ar-regs-official--title-6-part-230--6 CAR § 230-104}

6 CAR § 230-104. Review and revocation of waivers.

(a) The State Board of Education may exercise its right to review waivers granted under Arkansas Code § 6-15-103 and this part at any time.

(b)(1) If the state board chooses to conduct a review, it must give the school district superintendent and board of directors president at least fifteen (15) business days' notice in writing via both regular United States mail and email of the state board’s intent to conduct a review.

(2) This notification shall:

(A) Include the time, date, and location at which the review will be conducted;

(B) Provide the specific reasons for the state board’s intent to conduct a review; and

(C) State additional information that is required by the Division of Elementary and Secondary Education or the school district.

(c) A failure to notify a school superintendent and local district board of directors president as required under subdivision (b)(1) of this section shall result in a waiver of the right of the state board to conduct a review until the notification requirement is met.

(d) Following a review of a waiver or waivers granted under Arkansas Code § 6-15-103, the state board may modify, in whole or in part, or revoke, in whole or in part, the waiver or waivers.

6 CAR § 230-105 Expiration of waivers {#sec-6-car-230-105 omnilex-key=us-ar-regs-official--title-6-part-230--6 CAR § 230-105}

6 CAR § 230-105. Expiration of waivers.

(a) If a Standard for Accreditation of Arkansas Public Schools and School Districts, Arkansas law, or Division of Elementary and Secondary Education rule is repealed, any waiver or waivers of that standard, law, or rule expires on the date the repeal becomes effective.

(b) If a standard for accreditation, Arkansas law, or division rule is changed, it is the responsibility of the district to determine if the change necessitates a change in its waiver.

(c) The division shall advise districts by commissioner's memo when laws, rules, or the standards for accreditation that impact waivers are changed.

(d)(1) If the open-enrollment public charter school on which the district based its request closes or gives up its waiver, the district may maintain the waiver until the end of the school year.

(2) The district may bring a new waiver request based on another open-enrollment public charter school if another open-enrollment public charter school holds the waiver.

(3) If no other open-enrollment public charter school holds the waiver, the waiver will expire at the end of the school year.

(e)(1) If a district wishes to renew a waiver that is expiring, it must submit an Extension Request Form.

(2) The request form shall be available on the division's website.

(3) The district must submit the following in its extension request:

(A) The name of the open-enrollment public charter school that holds the waiver or waivers;

(B) A list of the waiver or waivers that the district seeks to have extended;

(C) The proposed duration of the extension;

(D) The grades, schools, and classes to which the proposed extension applies, if different than the original request;

(E) An explanation of the benefit of the waiver for:

(i) Students;

(ii) Staff;

(iii) The district;

(iv) The community; or

(v) The State of Arkansas;

(F) A signed copy of the resolution adopted by the school district's board of directors authorizing the district to request the waiver extension;

(G) Evidence of support from district staff for the continuation of the waivers; and

(H) A detailed rationale for the request, including but not limited to:

(i) How the waiver or waivers:

(a) Enhance student learning opportunities;

(b) Promote innovation; or

(c) Increase equitable access to effective teachers;

(ii) How students will be served; and

(iii) How the district will monitor and evaluate the effectiveness of the waiver.

(4) If the district is requesting an extension of teacher licensure waivers, the district must also provide the following information:

(A) The number of positions filled by a teacher employed under the waiver;

(B) The number of teachers employed under the waiver that have obtained licensure; and

(C) The number of teachers employed under the waiver that are actively engaged in a licensure pathway program.

(5)(A) The Extension Request Form must be received by the Charter School Office no later than forty-five (45) days prior to the expiration of the waiver.

(B) A district may submit an extension request after the timeline set in subdivision (5)(A) of this subsection, but the delay may result in a lapse in the waiver prior to extension.

(f) All waiver expiration dates shall be posted to the division's website.
