# REGOLAMENTO (CE) N. 788/2008 DEL CONSIGLIO

del 24 luglio 2008

che modifica gli elenchi delle procedure di insolvenza e delle procedure di liquidazione di cui agli allegati A e B del regolamento (CE) n. 1346/2000 relativo alle procedure di insolvenza e codifica gli allegati A, B e C di tale regolamento

## Preamble

IL CONSIGLIO DELL'UNIONE EUROPEA,

visto il trattato che istituisce la Comunità europea,

visto il regolamento (CE) n. 1346/2000 del Consiglio, del 29 maggio 2000, relativo alle procedure di insolvenza [^1] , in particolare l'articolo 45,

vista la proposta della Commissione,

considerando quanto segue:

**(1)** Gli allegati A, B e C del regolamento (CE) n. 1346/2000 elencano le denominazioni date nella legislazione nazionale degli Stati membri alle procedure e ai curatori cui si applica il regolamento. L'allegato A elenca le procedure di insolvenza di cui all'articolo 2, lettera a), di tale regolamento. L'allegato B elenca le procedure di liquidazione di cui all'articolo 2, lettera c), di tale regolamento e l'allegato C elenca i curatori di cui all'articolo 2, lettera b), di tale regolamento.

**(2)** Il 13 dicembre 2007 la Repubblica di Lettonia ha notificato alla Commissione, conformemente all’articolo 45 del regolamento (CE) n. 1346/2000, le modifiche da apportare agli elenchi degli allegati A e B di tale regolamento.

**(3)** A seguito delle modifiche apportate agli allegati A e B del regolamento (CE) n. 1346/2000 successivamente alla suddetta notifica da parte della Lettonia, si dovrebbe procedere ad una codificazione degli allegati A, B e C di tale regolamento, per offrire la necessaria certezza del diritto a tutti i soggetti coinvolti in procedure di insolvenza contemplate da tale regolamento.

**(4)** Il Regno Unito e l'Irlanda sono vincolati dal regolamento (CE) n. 1346/2000 e pertanto, ai sensi dell'articolo 45 del medesimo, partecipano all'adozione e all'applicazione del presente regolamento.

**(5)** A norma degli articoli 1 e 2 del protocollo sulla posizione della Danimarca allegato al trattato sull’Unione europea e al trattato che istituisce la Comunità europea, la Danimarca non partecipa all’adozione del presente regolamento e non è vincolata da esso né soggetta alla sua applicazione.

**(6)** Occorre pertanto modificare gli allegati A e B del regolamento (CE) n. 1346/2000 e codificare in conseguenza gli allegati A, B e C,

HA ADOTTATO IL PRESENTE REGOLAMENTO:

## **Articolo 2**

Gli allegati A e B modificati in conformità dell'articolo 1 del presente regolamento e l'allegato C del regolamento (CE) n. 1346/2000 sono codificati e sostituiti dal testo figurante negli allegati I, II e III del presente regolamento.

## **Articolo 3**

Il presente regolamento entra in vigore il giorno successivo alla pubblicazione nella *Gazzetta ufficiale dell'Unione europea* .

## Final provisions
