Sintesi Omnilex

X.________ filed a pleading labelled as an appeal against a Federal Supreme Court judgment of 19 April 2010 that had not entered into the merits for insufficient reasoning. The Federal Supreme Court treated the submission as a request for revision. It held that the applicant failed to identify any statutory revision ground and that mere criticism of the prior legal assessment is not admissible in revision proceedings. Without a written exchange of submissions, the court declined to enter into the request and waived court costs.

Massima Omnilex

Art. 121 ff. BGG; Art. 127 BGG; revision of a final Federal Supreme Court judgment requires a specifically pleaded and substantiated statutory ground. Revision is not a substitute for ordinary review and cannot serve to contest the legal assessment underlying the challenged judgment. If no revision ground is alleged, the court may decline to enter into the request without exchanging written submissions. Costs may be waived under Art. 66 Abs. 1 BGG.

Bundesverwaltungsgericht, Abteilung III, Postfach, 3000 Bern 14.

Gegenstand
Revisionsgesuch gegen das Urteil des Schweizerischen Bundesgerichts 1C_190/2010 vom 19. April 2010.
In Erwägung,
dass das Bundesgericht mit Urteil vom 19. April 2010 mangels einer genügenden Begründung im Sinne von Art. 42 Abs. 2 BGG auf die Beschwerde von X.________ nicht eingetreten ist (Verfahren 1C_190/2010);
dass X.________ mit Eingabe vom 26. April 2010 "Beschwerde" gegen das bundesgerichtliche Urteil vom 19. April 2010 eingereicht hat;
dass die Aufhebung oder Abänderung eines wie hier nach Art. 61 BGG in Rechtskraft erwachsenen Bundesgerichtsurteils nur bei Vorliegen eines Revisionsgrundes gemäss Art. 121 ff. BGG möglich ist;
dass die Eingabe vom 26. April 2010 somit sinngemäss als Revisionsgesuch zu behandeln ist;
dass der Gesuchsteller in seiner Eingabe nicht darlegt, an welchem Revisionsgrund (Art. 121 ff. BGG) der beanstandete bundesgerichtliche Nichteintretensentscheid leiden sollte;
dass im Revisionsverfahren eine Kritik an der dem angefochtenen Urteil zugrunde liegenden rechtlichen Würdigung nicht zu hören ist;
dass auf das Revisionsgesuch ohne Schriftenwechsel nicht einzutreten ist (Art. 127 BGG);
dass auf eine Kostenauflage verzichtet werden kann (Art. 66 Abs. 1 BGG);
erkennt das Bundesgericht:

1.
Auf das Revisionsgesuch wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird dem Gesuchsteller, dem Bundesamt für Migration und dem Bundesverwaltungsgericht, Abteilung III, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the request met the statutory grounds for revision of a final Federal Supreme Court judgment.

Decisione estratta

The filing did not invoke or substantiate any admissible ground for revision.

Motivazione estratta

A judgment that has entered into force may be altered only on revision grounds under Art. 121 ff. BGG. The applicant did not indicate any such ground and merely criticised the legal assessment underlying the prior non-entry judgment, which is inadmissible in revision.

Questione giuridica chiave

Whether the revision request could proceed to a written exchange of submissions.

Decisione estratta

No written exchange was ordered; the court entered no proceedings on the request.

Motivazione estratta

Because the request was manifestly insufficient, the court could refuse to entertain it without exchanging written submissions under Art. 127 BGG.
