Sintesi Omnilex

The Federal Court held that an administrative law appeal is not admissible against decisions on entry bans, and this exclusion also covers procedural complaints arising from a refusal to reconsider or non-entry. A constitutional complaint was likewise unavailable because the challenged decision was federal, not cantonal. The court therefore did not enter into the case under the simplified procedure and charged the appellant a court fee of CHF 500.

Art. 100 Abs. 1 lit. b Ziff. 1 OG; administrative law appeal against entry-ban decisions: the statutory exclusion extends, under the unity-of-proceedings principle, to all ancillary procedural objections, including allegations of denial of justice and violation of the right to be heard in connection with a non-entry decision. Art. 101 lit. d OG does not establish an exception for entry bans. A constitutional complaint under Art. 84 OG is inadmissible where the challenged act is not a cantonal decision. Where inadmissibility is manifest, the Federal Court may decide in simplified procedure under Art. 36a OG and allocate costs to the losing party under Art. 156 Abs. 1 OG in conjunction with Art. 153 and 153a OG.

Questione giuridica chiave

Whether the administrative law appeal was admissible against a decision concerning an entry ban and refusal to reconsider it.

Decisione estratta

The administrative law appeal was inadmissible because appeals in immigration matters are excluded for decisions on entry bans, including related procedural questions such as refusal to enter into the matter.

Motivazione estratta

Art. 100(1)(b)(1) OG excludes such appeals. Under the unity-of-proceedings principle, the exclusion covers not only the substantive entry-ban issue but also complaints of denial of justice and violations of the right to be heard arising from non-entry. Art. 101(d) OG did not create an exception here.

Questione giuridica chiave

Whether a constitutional complaint was admissible against the challenged federal decision.

Decisione estratta

The constitutional complaint was inadmissible because the challenged decision was not a cantonal decision.

Motivazione estratta

Art. 84 OG limits the constitutional complaint in this context to cantonal decisions; that requirement was not met.

Questione giuridica chiave

Whether the court could decide without further written exchange under the simplified procedure.

Decisione estratta

The court declined to enter into the case in simplified procedure without further exchange of submissions.

Motivazione estratta

Because the appeal was clearly inadmissible, the court applied Art. 36a OG.
