The Federal Supreme Court noted the appellant's withdrawal of the civil appeal against the judgment of the Vaud cantonal appeal chamber and struck the case from the docket. The appellant had previously been denied legal aid and was ordered to pay a CHF 5,000 advance, later extended. After withdrawal, the court ordered a reduced judicial fee of CHF 200 against the appellant and communicated the order to both parties and the cantonal court.
Art. 32 al. 2 LTF; withdrawal of a civil appeal; striking the case from the docket. Upon valid withdrawal of the appeal, the Federal Supreme Court takes note thereof and removes the cause from the roll. Costs are allocated according to the Federal Supreme Court Act, including when proceedings are terminated by withdrawal; the amount of the judicial fee is determined under Art. 65 and the allocation of costs under Art. 66 LTF, as applicable in the circumstances (consid. 1).

vu la décision du 15 août 2007 par laquelle la Ire Cour de droit civil du Tribunal fédéral a rejeté cette demande;
vu l'ordonnance présidentielle du 20 août 2007 invitant la recourante à verser une avance de frais de 5'000 fr. jusqu'au 5 septembre 2007 au plus tard, délai prolongé jusqu'au 15 octobre 2007 sur demande de la recourante du 4 septembre 2007;
vu la lettre du 16 octobre 2007 par laquelle le mandataire de la recourante déclare retirer le recours.
Considérant qu'il y a lieu de prendre acte de ce retrait et de rayer la cause du rôle (art. 32 al. 2 LTF).
Vu, quant aux frais, les art. 65 al. 1, 2 et 3 let. b ainsi que 66 al. 2 et 3 LTF.
Ordonne:

Il est pris acte du retrait du recours en matière civile.

La cause 4A_213/2007 est rayée du rôle.
3.
Un émolument judiciaire de 200 fr. est mis à la charge de la recourante.

La présente ordonnance est communiquée en copie aux mandataires des parties et à la Chambre des recours du Tribunal cantonal vaudois.

Whether the withdrawn civil appeal should be taken off the docket
The court noted the withdrawal of the appeal and removed the case from the docket.
Once the appellant's counsel declared the appeal withdrawn, there was no need to proceed further; the case had to be struck from the docket under Art. 32(2) LTF.
Allocation of court costs after withdrawal of the appeal
A court fee of CHF 200 was imposed on the appellant.
Costs were determined under the Federal Supreme Court Act provisions cited by the court for fees and cost allocation.
