X.________ SA filed a civil appeal to the Swiss Federal Supreme Court against Procedural Order No. 7 of the ICC arbitral tribunal in Geneva. Before the respondent’s reply period expired, the appellant withdrew the appeal by letter. The President took note of the withdrawal, struck the case from the docket, and ordered the appellant to bear reduced court costs of CHF 800 and to pay the respondent CHF 8,000 in reduced party compensation.

l'ordonnance présidentielle du 21 octobre 2008 invitant l'intimée à déposer une éventuelle réponse au recours jusqu'au 24 novembre 2008;
la réponse au recours de l'intimée du 20 novembre 2008;
la lettre datée du 21 novembre 2008, mais remise à la poste le 24 novembre 2008, par laquelle le mandataire de la recourante déclare retirer le recours;
considérant:
qu'il y a lieu de prendre acte du retrait du recours et de rayer la cause du rôle (art. 32 al. 2 LTF);
que la recourante supporte les frais judiciaires réduits et verse à l'intimée une indemnité de dépens réduits (art. 66 al. 2 et 3, art. 68 al. 4 LTF; art. 8 al. 3 du Règlement sur les dépens alloués à la partie adverse [SR 173.110.210.3]);
par ces motifs, le Président ordonne:

Il est pris acte du retrait du recours en matière civile.

La cause 4A_456/2008 est rayée du rôle.
3.
Les frais judiciaires, arrêtés à 800 fr., sont mis à la charge de la recourante.

La recourante versera à l'intimée une indemnité de 8'000 fr. à titre de dépens.
5.
La présente ordonnance est communiquée aux parties et au CCI Tribunal arbitral Genève.

The court took note of the withdrawal and ordered the case struck from the docket.
Once the appellant withdrew the appeal, the proceedings had to be terminated by striking the case from the docket under the Federal Supreme Court Act.
Allocation of court costs and party compensation after withdrawal of the appeal
Reduced court costs and reduced party compensation were imposed on the appellant.
Because the appeal was withdrawn, the appellant had to bear the reduced judicial costs and pay the respondent reduced costs of representation.
